Mitchell Aircraft products, Inc. (MITCHELL) warrants its products to be free from defects in materials and workmanship for a period of two (2) years from the date of shipment from MITCHELL. Products manufactured by others but furnished by Mitchell are are exempted from this Warranty and are covered by the original Manufacturer's Warranty. This Warranty extends only to the original retail purchaser. This Warranty shall not apply to products which are subjected to, but not limited to, accident, misuse, improper maintenance, alteration, misapplication, negligence, tampering, damage from external causes or use of product for which it was not designed or contrary to operating instructions.

MITCHELL'S sole obligation under this warranty shall be to rebuild or replace any product(s) which MITCHELL determines, in its sole discretion, to be defective. MITCHELL reserves the right to request their prepaid return to MITCHELL> MITCHELL shall not be responsible for any transportation charges, including but not limited to duty, taxes, freight, labor or other costs. The cost of removing and/or installing product(s) which have been rebuilt or replaced shall be at the purchaser's sole cost and expense.

MITCHELL instruments which have had the bezel opened for range-marking must have documentation identifying the date and technician/facility involved for MITCHELL'S Warranty coverage to remain valid. UNDER NO CIRCUMSTANCES ARE EITHER THE DIAL OR THE POINTER PERMITTED TO BE REMOVED OR THE REAR CASE SEAL BROKEN.

EXCEPT AS PROVIDED HEREIN, MITCHELL MAKES NO EXPRESSED OR IMPLIED WARRANTIES AND THERE ARE NO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. mITCHELL SHALL HAVE NO LIABLITY OR RESPONSIBILITY TO PURCHASER OR ANY OTHER PERSONOR ENTITY WITH RESPECT TO ANY LIABILITY, LOSS OR DAMAGE CAUSED OR ALLEGED TO BE CAUSED DIRECTLY OR INDIRECTLY BY MITCHELL'S GOODS OR SERVICES, INCLUDING BUT NOT LIMITED TO ANY INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OF PROFITS, LOSS OF VEHICLE USE, LOSS OF TIME, INCONVENIENCE, OR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES. THE FOREGOING SETS FORTH MITCHELL'S ENTIRE AND EXCLUSIVE LIABILITY AND PURCHASER'S EXCLUSIVE AND SOLE REMEDY FOR ANY AND ALL CLAIMS OF DAMAGE IN CONNECTION WITH THE SALE OF THE PRODUCT(S). MITCHELL SHALL NOT BE LIABLE FOR ANY LOSS ARISING OUT OF OR RELATING TO THE SALE OR OPERATION OF THE PRODUCT(S) WHETHER BASED ON CONTRACT, TORT, INCLUDING NEGLIGENCE, STRICT LIABILITY OR OTHERWISE.
